Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Feedfrwd platform, website, and related services (collectively, the “Services”) provided by Feedfrwd, Inc. (“Feedfrwd,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

1. Overview of Services

Feedfrwd is a business-to-business software-as-a-service (SaaS) platform designed to:

  • Aggregate feedback and operational data from third-party systems

  • Structure and analyze such data using AI models

  • Generate ranked recommendations and insights

  • Integrate with customer workflows and backlog systems

  • Provide impact tracking tied to business metrics

The Services may include:

  • Web application access

  • APIs

  • Embedded widgets

  • AI-powered recommendation engines

  • Integrations with third-party systems

2. Eligibility

The Services are intended solely for use by businesses and authorized business users.

You must:

  • Be at least 18 years old

  • Use the Services in a business capacity

  • Have authority to bind your organization

Feedfrwd is not intended for consumer use.

 

3. Customer Accounts

You are responsible for:

  • Maintaining the confidentiality of account credentials

  • All activity under your account

  • Ensuring authorized users comply with these Terms

You must notify Feedfrwd promptly of any unauthorized access.

 

4. Customer Data

 

4.1 Ownership

You retain all rights to data you submit, upload, or connect to Feedfrwd (“Customer Data”).

Feedfrwd does not claim ownership of Customer Data.

4.2 License to Process

You grant Feedfrwd a limited, non-exclusive license to:

  • Process

  • Analyze

  • Store

  • Transmit

Customer Data solely for the purpose of providing and improving the Services.

4.3 Responsibility for Data

You are responsible for:

  • Ensuring you have legal rights to the data you connect

  • Compliance with applicable data protection laws

  • Providing appropriate notices to your end users

5. AI-Generated Content and Recommendations

Feedfrwd uses machine learning and AI systems to generate insights and recommendations.

You acknowledge that:

  • AI-generated outputs are probabilistic

  • Recommendations are advisory only

  • Final business decisions remain your responsibility

Feedfrwd does not guarantee specific business outcomes, KPI improvements, or performance results.

6. Third-Party Integrations

The Services may connect with third-party platforms such as:

  • Zendesk

  • Salesforce

  • Intercom

  • Freshdesk

  • Genesys

  • GitHub

  • Slack

  • Project management tools

Feedfrwd:

  • Does not control third-party systems

  • Is not responsible for third-party platform performance

  • Is not liable for changes to external APIs or integrations

Your use of third-party services is subject to their respective terms.

7. Data Security

Feedfrwd implements reasonable administrative, technical, and organizational safeguards to protect Customer Data.

These may include:

  • Encryption in transit

  • Role-based access controls

  • Secure infrastructure practices

  • Monitoring and logging

However, no system is completely secure, and Feedfrwd does not guarantee absolute security.

If applicable, a separate Data Processing Agreement (DPA) may govern personal data processing.

8. Confidentiality

Each party agrees to protect the other’s Confidential Information and use it solely for purposes related to the Services.

Confidential Information does not include information that:

  • Is publicly available

  • Was lawfully known prior to disclosure

  • Is independently developed

9. Acceptable Use

You may not:

  • Use the Services for unlawful purposes

  • Attempt to reverse engineer the platform

  • Interfere with system integrity or performance

  • Circumvent access controls

  • Upload malicious code

  • Use the platform to process data without appropriate authorization

Feedfrwd may suspend access for violations.

10. Fees and Payment

If you purchase a subscription:

  • Fees are billed as agreed in your order form

  • Payments are non-refundable unless stated otherwise

  • Late payments may result in suspension

Enterprise agreements may override this section.

11. Intellectual Property

Feedfrwd retains all rights to:

  • The platform

  • Software

  • Algorithms

  • Models

  • Branding

  • Documentation

Except for Customer Data, no rights are transferred to you.

12. Service Availability

Feedfrwd will use commercially reasonable efforts to maintain availability but does not guarantee uninterrupted service.

Maintenance, updates, and external dependencies may cause downtime.

​

13. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”

Feedfrwd disclaims all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy of AI outputs

  • Guaranteed business results

14. Limitation of Liability

To the maximum extent permitted by law:

Feedfrwd’s total liability arising out of or related to the Services shall not exceed the fees paid by Customer in the 12 months preceding the claim.

Feedfrwd shall not be liable for:

  • Indirect damages

  • Lost profits

  • Lost revenue

  • Loss of data

  • Business interruption

15. Indemnification

You agree to indemnify Feedfrwd against claims arising from:

  • Your misuse of the Services

  • Violation of laws

  • Infringement related to Customer Data

​

16. Termination

Either party may terminate:

  • As specified in an order agreement

  • For material breach (with cure period)

Upon termination:

  • Access to the Services will cease

  • Customer Data will be deleted according to your agreement or applicable DPA

​

17. Governing Law

These Terms shall be governed by the laws of:

Washington State and the United States

Without regard to conflict-of-law principles.

18. Changes to Terms

Feedfrwd may update these Terms.

Material changes will be communicated via:

  • Website notice

  • Email notification

  • Platform announcement

Continued use constitutes acceptance.
